Preamble: illegal broadcasting in Cornwall, Group: Spectrum , Closed Date: 25 November 2013.

1. How many pirate radio stations or illegal transmissions on band 2 (87.5 to 108 MHz)
were reported or discovered in Cornwall between 2008 and 2011? Were any in or
around the Newquay area?


There was one report of a pirate radio station of illegal broadcast in Cornwall between 2008
and 2011. It was located in Newquay.

2. Please list the names of all the unlicensed broadcast stations if known and the
number of times enforcement action has been carried against each of them, clearly
showing the method of enforcement used (I.e.: studio raid, main transmitter removal,
mobile telephones disconnected, website domain name blocking etc).


July 2009 – Band II transmitter and mid-link operation. We are unable to provide you with the
station names, operating area or used frequencies. This information is being withheld under
section 31 of the Act, which relates to law enforcement and the functions of a public
authority. In applying this exemption we have had to balance the public interest in
withholding the information against the public interest in disclosing the information. In the
annex I have set out the exemption in full, as well as the factors Ofcom considered when
deciding where the public interest lay.

Other exemptions may apply to this information.

3. Were there any unlicensed broadcasts that were reported or discovered by a band
scan but not traced and/or prosecuted? How many warrants were issued to search for
illegal broadcasting equipment?


There were no unlicensed broadcasts reported or discovered by a band scan and not
traced or prosecuted in Cornwall, during 2008 to 2011.

4. How many enforcement visits have been made and how many as a result from
information supplied from members of the public or license paying broadcasters?


As question 2.

5. How many reports of interference to safety of life services or aviation have been
reported in Cornwall between the dates stated above, if any please state which
authority reported it and if the interference was proven to be attributed to pirate radio?


There were no reports of interference to safety of life services or aviation reported in
Cornwall between 2008 and 2011.

6. What was the average sentence given for the successful prosecutions?

There were no prosecutions undertaken in Cornwall, during 2008 and 2013.
