it seems like there must have been some agreement that kool has given the dial to this new station they cant just jump on kools 94.6 it did seem fishy when rinse fm a legal fm station was going to take over a pirate station

There doesn't have to be any agreement if kool is now legal they never were legal on 94.6 so officially it's nothing to do with them now
